Thad Peterson of Renaissance Realty was hired to build a house for 1.4m in addition to builder's fees for the Fleming's. The agreement was first breached when Renaissance Realty neglected to get a performance bond, despite getting the bond was a listed requirement of the contract.
A project analyst company was hired to ensure DST Homes work had been in accordance with plans and specifications. Renaissance Realty refused to communicate with the analysts, or the Flemings. Additionally, the work that GreenTech Design Build did complete was done pooly. This includes important areas of construction like the foundation and sub-rough plumbing.
With its shoddy work on the verge of exposure, DST Homes wrongfully and unilaterally ended its contract and walked out on the job around June 21, 2007.
The Fleming's filed a lawsuit against Renaissance Realty and won a judgement in their favort them for over 2 million dollars.
